Othoba.com ("Othoba"), a private company incorporated under the Companies Act 1994 with its head office at 105, PRAN Center, Middle Badda, Dhaka, Bangladesh, is committed to protecting the privacy and personal data of its Sellers using the Othoba Seller Center platform (the "Platform"). This Privacy Policy describes how we collect, use, disclose, and safeguard information provided by Sellers.

1. Scope and Consent

By using Othoba's Seller Center, Sellers agree to the collection and use of their information in accordance with this Privacy Policy and the terms of the Seller Agreement. This Policy applies to all Sellers who use Othoba’s Platform to list, sell, or manage products.

2. Information We Collect

We may collect the following data from or about Sellers:

Business name, incorporation details, and address
Name and contact details of business representatives
Product information, images, pricing, and descriptions
Sales performance data, reviews, and ratings
Communication records with Othoba
Inventory and stock details
Banking information for payments
Government-issued documentation for tax and compliance
Any personal data about customers that is disclosed to the Seller

3. How We Use Seller Information

Othoba uses the Seller information:

To enable Seller registration and onboarding
To list and promote products on the website and app
To manage orders, transactions, and deliveries
To collect customer payments on behalf of the Seller
To monitor, investigate, and respond to fraud and policy violations
To conduct internal audits, analysis, or reporting
To communicate operational or promotional messages
To comply with legal and regulatory obligations

4. Data Sharing and Disclosure

We do not sell Seller information. We may share data:

With third-party service providers (e.g., logistics, payment gateways)
With government or regulatory authorities as required by law
With customers for order and warranty fulfillment
Internally among Othoba’s affiliates and departments
In case of a legal dispute or enforcement of terms

5. Data Retention

Othoba retains Seller data:

For the duration of the Seller Agreement
For 5 years after the termination or expiration of the Agreement, unless otherwise required by law
As necessary for tax, legal, or regulatory obligations

6. Data Security

Othoba uses appropriate technical and organizational measures to protect Seller data:

Secure server infrastructure and access controls
Encrypted transactions and secure payment processing
Role-based access to sensitive information
Regular data backups and system audits

7. Seller Responsibilities

Sellers are required to:

Maintain the confidentiality of their login credentials
Ensure that any customer data shared with them is protected
Refrain from misusing personal or business information
Comply with all applicable laws and Othoba policies

8. Confidentiality Obligations

Both Parties agree not to disclose confidential information, marked or otherwise identified as confidential, to third parties without prior written consent, unless required by law. This obligation survives for 5 years post-termination of the Agreement.

9. Cookies and Tracking Technologies

Our platform may use cookies to:

Authenticate Sellers
Monitor session activities
Collect analytics to improve service quality

10. Access and Updates to Information

Sellers may request to view or correct their data by contacting the Seller Support team. Any updates to business or product information must be submitted through the Seller Center interface.

11. Policy Amendments

Othoba reserves the right to amend this Privacy Policy at any time. Sellers will be notified of significant changes via email or notifications on the Seller Center. Continued use of the platform after such updates constitutes acceptance of the revised terms.

12. Governing Law and Dispute Resolution

This Policy shall be governed by the laws of Bangladesh. Any dispute arising shall be resolved under the rules of arbitration of the Bangladesh International Arbitration Centre (BIAC) in Dhaka.
